Legal Question in Discrimination Law in Pennsylvania

sexual orientation discrimination

I work for the largest home improvment corperation in America.Approx. 1 1/2 years ago I was promoted t Department manager thats when some of the associates hand made some signs re: gender(I am female) and posted them in the aisles for customers to see. This was reported to our human resource person and a investigation was done with ''no findings''..presently two associates said inappropriate remarks about my sexual orientation. This was reported to Human resources and the two associates did say that it was them and then they said other inappropriate things to other associates about me and so on and so on(also reported to human resources). My car has been vandalized(reported) one of the associates has become very hostile(reported) and because of an injury at work earlier in 2006 they told me I had to leave(light duty expired asper corp.) and when I come back they do not have to hold my position and I will most likely have to transfer to another store! Now I dont want to transfer to another store(this one is local) and I need to know how can I stop this from happening, also how can i stop the harrassment from the associates?I am afraid to loose my job( I am a single mom w/a disabled son) and I dont want to get physically hurt.

Re: sexual orientation discrimination

You asked about discrimination that seems to be on several levels.

You really need to speak with an attorney immediately. An attorney can advise you of various option including filing a complaint with the Pennsylvania Human Relations Commission and the EEOC. These should be filed in consultation with an attorney.

Further, there seems to be an issue with regard to fair application of the light duty policy.

Sometimes the only way to handle an employer is to get very aggressive and demonstrate that you won't be bullied.

I would be happy to speak with you about potential representation.

Regards,

Roger

Re: sexual orientation discrimination

Normally people who are discriminated against in such a fashion choose to complain to the EEOC (a federal agency) or to the PHRC (a state agency). There are subtle differences between these but both agencies handle discrimination such as described in your e-mail.

If you would like to speak to an attorney who has handled many such cases, e-mail me your name and telephone number. I will have my partner, David Dessen, contact you to discuss this at length. There is no charge for a consultation and he will be able to tell you some of the benefits to choosing one of the agencies over the other.
