car totalled by drunk driver

My car was hit by a drunk driver and totalled. Other than being sore for a couple of days I'm ok physically. My insurance company is only offering me the blue book value of my car which was $5100. I still owed $3100 on the loan of my car now they pay that off and I'm left with $2000 it just doesn't seem fair so I'm out of a car and with $2000 to get a car and a new loan is this right? It seems since he was in the wrong and was arrested at the scene for dui that i would be better compensated. Well hope you can help.

Your insurance company isn't there to compensate you for a drunk driver hitting you. If you want to collect more, you need to sue the drunk driver. Then his insurance company may come up with something. However, given that you don't have a lot of physical injury, the amount would be questionable.

You have two options the first following up with the DA which is prosecuting the case, they may be able to attach commensation to any deal they may offer the Defendant, you can also sue him civily for the difference......please feel free to contact our offices at 412.731.0865.
