Legal Question in DUI Law in Pennsylvania

Driving while inder suspension DUI related

I was cited for driving under suspension recently and wanted to know what could happen as a result of this. The officer pulled me over for making a left turn where there wasn't one and I would never have driven if my 6 month old son didn't need any formula. No one was home at the time to take me to the store and the baby was very hungry. Will I serve jail time for this? Also I'm starting school in January to pursue nursing. Will this harm my licensure if convincted?

Re: Driving while inder suspension DUI related

In Pennsylvania, there is mandatory jail time if you are caught driving with a DUI related license suspension. The District Justice really has no discretion in this case and will probably not care much about your reasons. As for how this will affect your possible nurses license, I am not sure. But this is not a criminal suspension, it is a moving violation. You already have the criminal record for the DUI and I assume that that may affect your ability to obtain a nursing license more. Your punishment will likely depnd on the county you were pulled over in. The offense does carry mandatory jail time 60 days minimum to be exact. The offense is a summary offense and should not disqualify you from a nursing license. You may a jusitification defense. I offer free initial consultations.
