Legal Question in Family Law in Pennsylvania

Fraudelant Divorce

I am a NY resident whose current marital status is currently divorced. I was married in the state of PA.

I never signed any paperwork regarding a divorce.

Under PA state law is a signature from both parties required to complete divorce proceedings. If so would forgery on divorce proceeding documents be a criminal offense.

Re: Fraudelant Divorce

Your wife had to file for divorce and have you served personally, for the state [PA or NY], to obtain jurisdiction over you.

For her to obtain a divorce, it is not necessary that you sign anything, only that you are served. If you were served, but you defaulted, then you may be able to have the default set aside if you act promptly.

Hope this helps.
