Legal Question in Family Law in Pennsylvania
Grandparents with custody
Five years ago our grandson's mother requested we file for custody of her two year son. He had been living with us since the age of 19 months. She is getting married soon, but not to our son. What are her chances of getting custody of her son now? Can she also change our grandson's name to her new married name without our sons permission?

Re: Grandparents with custody
I do not have enough information at this time to be able to give yoi an opinion about the possibility of the mother getting custody. As the natural mother, though, she always has a right to seek custody unless her rights have been terminated. The Court will look at what is in the best interests of the child.
As concerns the name change, she should not be able to chagne the child's name without the permission of the father. At the very least, there should be a court hearing first.
