Legal Question in Family Law in Pennsylvania
Moving out of state
I filed for divorce in Aug. 2005 - husband will not sign papers so will go thru in Aug. 2007. I want to move to Macon, Georgia with my 2 children ages 7 and 10. Am I allowed to do that?

Re: Moving out of state
If there has been no action for custoduy filed, nor a count for custody in the divorce complaint you should take the children and move to Georgia and immediately file for custody there. If Custody has been brought in PA you are going to have to show a number of things to get permission to permanently move. First that the move is for economic reasons and will improve the lives of the children thereby. Second, there is no alternative locally. Finally that depriving the other party of custody is not your motavation. This kind of custody fight is very complicated and should almost never be undertaken without a lawyer.
