Shared Custody - abandonment?

I have shared physical and legal

custody of my 5 year old son with

his Father. In early December, the

father was jailed due to driving

under the influence and with no

license. Since this incidence (2

months ago), he has failed to make

contact with me and his son. At this

point, I'm afraid to even turn my

son back over to him because he

has no defined job or place to live. I

fear he could be unstable physically

and emotionally. What should be

my next steps?

Since you evidently have a court order, you should file a petition to modify it in order to address your concerns with the court.
