Legal Question in Civil Litigation in Pennsylvania

Lost Shoe

I took two pair of shoes (one old / one new) to a repair shop. The old ones needed repaired and the new (just one shoe) needed to be stretched. When I went back the following week to pick them up, the owner couldn't find my new shoe. I asked the owner what he would do if he doesn't find it and he said, ''buy you a new pair of shoes''. I gave him my telephone number in case he found it or someone else returned it. I waited a month and then called him. The owner said he didn't find the shoe and wouldn't compensate me in any way because his ticket stub says ''Not responsible for shoes lost, damaged by fire or left over 30 days''. Is the owner really not responsible for losing shoes? I can't make him reimburse me for my lost shoe?

Re: Lost Shoe

The shoe repair shop negligently lost your shoes. You informed them within 30 days that they lost the shoes. Ipso facto you complied with the 30 day requiremnt. Your best bet is to file a claim in the district court which has jurisdiction over the location of the shoe repair shop.
