Legal Question in Medical Malpractice in Pennsylvania

Not informed of pap results until 14 mths later

I recv'd a call from my doctor about 3 weeks ago stating I need to have another pap smear and well I should of had one last Feb., but they had misplaced my results due to a new system being put in place in office for patients records and the results showed high squamous cell. I had a biopsy and now have to have a LEEP. I know that w/cancer time is of the essence. I have not been diagnoised w/cancer as of yet and hope not, but they have put me thru h----. Do I have a case for medical malpractice?

The loss of your records which delayed your discovery of a high grade lesion is inexcusable. To determine whether you have sufferred a harm due to this delay depends upon your hvp status your age and your prior history of pap smears. Depending on the degree of abnormality present and further information mentioned above, it may be the case that the delay has resulted in your having a stage of disease which will require further care than would have been required earlier.
