Subletting agreement

I was going to sublet off someone's father (me move in as a roommate with his son). It was a verbal agreement for me to move in on the 16th of april, on the 12th I called and told them that I would not be moving in. I explained that with my job his son's illegal activities like smoking marijuana, underage drinking and throwing parties with underage persons could ultimately make me lose my job (I am over 21).

This decision by myself was made after he told me he threw a party and his friends painted murals on the walls of the place I was meant to move into. I decided I didn't want to move in.

After him threatening to throw my things on the porch (I had 2 boxes of stuff in a closet there) I finally got those back. Although his father refuses to give back the rent I paid prior to moving in...

Do I have the right to take this to small claims court?

The maxim is you can sue anybody for just about anything. Though I don't recommend it.

In your case you can take him to District Magistrate court. It will cost you some filing fees which will be paid by the defendant if you prevail.
