ssi or ssd

My ex is reapplying for SSI and he keeps telling me that the child support will be dropped because he doesn't have to pay if he is on SSI. So I wanted to know if that was true because i thought any income you have to pay child support? And I am also on welfare, will my cash stop if he doesnt have to pay child support?

SSI is a welfare program, with limited benefits . SSI cannot be attached/garnished for support.

If your ex has worked and paid SS tax, he may be eligible for Disability. SS Disability is not a welfare program and provides for an auxiliary payment for children.

But he is not yet on SSI or SSD, so he may be obligated to pay support. Your local court may not believe that he is disabled and issue a support order.

The issue here is really child support not SSI. If you re-post the question under PA Child Support it is likely that a support attorney would give you a good explanation of how things work in your county.

If you ex hits the lottery, his SSI ends and you can enforce the support order, including the arrearage.
