Legal Question in Traffic Law in Pennsylvania
My son ran into a problem with his license while working a month ago. He was doing delivery's during one of our snow storms totaled his truck and then found out his license was suspended by receiving a ticket in the mail after the accident. What happened is after he was sentenced in April 2010 for Possession charges he got a letter in the mail from PennDot suspending his license for Vehicle code 13A16 and
even though the judge did not specify that in court. I paid $200 on June 22 for his appeal he was supposed to have a hearing but he was never notified regarding a hearing. We just got his history and Penndot is saying a notice went out Nov 1 regarding the suspension which he never received and Bensalem police were not notified to pick it up either. Do you know if there is anything he can do to fight for his license to be reinstated because the judge didn't specify that or find out the reason there was no hearing. He pleaded not guilty and the judge let him have a 30 day continuance to find out what happened. He doesn't know where to start and I figure he needs to talk to Penndot. I'd like to know what happened to the $200 for a hearing he never had.

There is a mandatory 6 months suspension for conviction of Possession. The question would be notice of the suspension and I would need more facts to determine if he has a defense. If the ticket occurred in Bensalem, usually the police there are pretty willing to work things out. If he gets convicted of Driving Under Suspension a one year suspension is added on.
As far as the $200, that sounds like the fine/collateral needed for the traffic hearing but again, I would need some additional information.
