If my spouse and I passaway and our stepson is to get half of our estate, but at the time of the reading of the will he is also disceased does his child get his half of the estate or does his half go to our daughter who gets also half of the estate?

I would have to see the will. The will should specify what happens if your stepson dies. If it does not, then you need to revise your will to make it clear. Do you want his child to inherit or not? I am not passing judgment. You and your spouse need to have a frank discussion about what will happen to your assets and you need to see an attorney to ensure that your wishes are clearly stated in your will.
