Legal Question in Workers Comp in Pennsylvania

Hospital billing me for a work related injury.

In May of 2002, I was working for a warehouse which required me to drive a forklift. One day I was putting a stack of empty pallets onto a trailer when some dirt had flew off the pallets and went into my eye. I had to go to the Emergency Room to get the dirt out. All required information was given to the hospital staff. They removed the dirt and I went back to work to get my vehicle so I could go home for the evening.I started getting bills from the hospital for E-Room services. I took the bills to work and human resources said they would take care of it, well the hospital is still sending me bills for their services. I gave human resources these bills at least four times since the accident and still nothing is settled almost a year after the fact. I thought that a work related injury should be paid for by the employer in full. Is this correct and what course of action should I take? The hospital just sent me a bill on 4/23/03 and is saying this is a delinquent bill. I am no longer with this company since March of this year. Another problem is I have just gone through a Chapter 7 Bankruptcy and don't have the money to hire an attorney. Any help would be appreciated. Thank You

Your old employer, or its workers comp ins co, is responsible for the bill. You should call the hosp & speak to a supervisor in the patient accounts or billoing office. Make sure the hosp has the correct information to submit the bill to the employer, or to the ins co if you have that info. Remind the hosp that under the workers comp law they have to submit the bill to the employer. Good luck!!

There is no question that your employer is responsible for payment of the bill. You ahould either consult a lawyer, or file a claim petition on your own to get the bill paid.
