Legal Question in Workers Comp in Pennsylvania

Third Party

In my WC case there was a third party involved. We hired the same attorney to handle both cases. My employer would not release the name of the other party.Well now the WC case has been decided and I lost and it needs to go to appeal. The attorney quit the liability case because he said he could not find out the name of the third party, hire a new attorney, the statute of limitations runs out in 30 days. Does an attorney that is handling the WC case, if he knows there is a third party involved, have an obligation to us to find out who it is?

Your attorney had an absolute duty to discover the identity of the 3rd party. If your new attorney can't do it because of the time involved, you might have a legal malpractice case.
