Legal Question in Family Law in Philippines

Nullity of Marriage

I got married in the Philippines to a man I didn't know was already married. He had our marriage nullified in the superior court of california, county of san francisco in 1995. Can I use this document to secure declaration of nullity of marriage from our local court? I am engaged to a foreigner and I want everything legal. Do I have to get an authenticated certified true copy of the judgment of nullity from the superior court of california?

Re: Nullity of Marriage

The better course of action is for you to just file a petition for declaration of nullity of your marriage before the appropriate Philippine court.

If your husband is a foreigner, you may make use of the decision obtained by your husband with the Superior Court of California but you must cause authentication of that at the Philippine Embassy of California. That alone will not suffice. You still have to file a petition in Philippine Court for the recognition of that Decision obtained by your husband. It will also take time to do that and so my recommendation is for you to just file a petition for declaration of nullity of your marriage before the Philippine Court.
