Legal Question in Credit and Debt Law in South Carolina

Not paying bills on time or at all

I have a lot of bills that have gone unpaid. I also have payday loan advances and I am just in over my head with debt. Should I think about bankruptcy?

Re: Not paying bills on time or at all

Bankruptcy may indeed be the solution for you. It will give you a fresh start, a breathing period where creditors are not allowed to send collection efforts your way (phone calls, letters, etc.), and depending on the chapter you select will give you either an outright discharge of legal liability for most debts, or will allow you to repay your debts in a way that's much more comfortable, most likely.

However, it's impossible to say whether bankruptcy is the best solution for any individual, or if so, what chapter is best, without sitting down with the individual and going over debts, income, expenses, and assets.

I urge you to locate a consumer bankruptcy attorney for a consultation as soon as possible. Although you're allowed to represent yourself in bankruptcy proceedings, in my opinion bankruptcy is one kind of legal case that should not be pursued without the help and advice of legal counsel. It's just too complex and complicated.
