Consent Agreement

My son signed a consent to adopt for his child because he was told that since the mother had signed her consent, he had no legal right because they were not married to each other. Is there a way to undo this? The child will be six months old soon and we would like to know if there are any steps that can be taken to reverse this signature. He felt that he was cheated and forced to sign this document because he was told that he had no rights. Both him and the mother wants the child back, can you please help?

I don't know the law in South Carolina, being from Ohio. A lot will depend on the current status of the child. If the child has already been adopted and the father was duly notified of the proceeding, I don't know if anything can be done. Prior to that, I would think the father could intervene in a termination of parental rights proceeding or adoption proceeding. If something is pending, go to the court and let it be known that you are an alleged father and wish to contest. You could also file your own action to establish the child parent relation (formerly known as a paternity action is less politically correct times) or you may be able to file for custody. In any event I would seek an attorney to represent you.
