Legal Question in Civil Litigation in South Carolina

Falsely accused of dog attack

A lady jogging in our neighborhood stopped at our driveway when our Boston Terrier ran out to greet her. She asked me why he didn't bark and stated "his feet are wet" when he put them on her leg wanting to be petted. I picked him up and put him in the house. Two weeks later I receive a letter that she is suing us because our "Dalmation" attacked and hurt her. I was the only witness, I KNOW she was NOT injured, and she has continued to jog by daily since the "attack". What chance does she have of winning this case?

Based on the facts you provide, I would say her chances of recovering against you are very slim. However, you should forward what you received to your homeowner's insurance carrier immediately. They will retain an attorney to defend you.
