Legal Question in Family Law in Tennessee

State to state custody

I was divorced in Tennessee, and my ex-husband got full custody of our 2 children. I got visitation. If I want to change that so we have joint custody do I have to go back to Tennessee or can I do that here in Michigan. We both live in Michigan, but we never turned anything in to friend of the court or anything to only papers we have for cupstody are our divorce papers and nothing is very spacific in there. Do we have to go to court or can we just have someone do the paperwork for us. He might not agree to everything I want.

Hello, I have received a copy of your e-mail. You can file for a change of curtody in either Tennessee or in Michigan. Tennessee retains jurisdiction because that is where the original custody order was entered. Michigan also has jurisdiction because that is where all of the parties reside. If you and the child's father agree that you should now have custody, you can retain an attorney and have him/her draw up the papers. It would take only a couple of weeks if the 2 of you agree. If there is no agreement you may still file for a change of custody if that is in the best interest of your child.
