Legal Question in Medical Leave in Tennessee
FMLA- Intermittant Leave
I have been approved for FMLA-Intermittant Leave - for my Rheumatoid Arthritis. After this was approved, my supervisor advised me that I have to have a dr's excuse for every time I am out and use my FMLA. Is this legal for them to require this? I have asked the Wage & Labor Div in TN and they said that the medical certification should be enough. I am looking at disciplinary action every time I use FMLA w/out going to the dr. Also, the dr's note has to have a diagnosis on it - such as R.A. or it is not acceptable and I cannot use FMLA. Please advise - I am so very tired of this - I feel as if I am being harassed every time I use FMLA.

It depends on what your condition is, the reason for the leave and what exactly the doctor's note said in the first place. Generally, speaking the intermittant leave documentation should be enough. If they are harassing you, they must stop.
