Legal Question in Employment Law in Tennessee

Soliciting employee donations

In a business organization, are there restrictions on the manner in which/when/how many times in a given period an employee may be solicited to contribute to a fund sanctioned by the organization? Example: A company has an Have a Happy Day Fund for employees and the money in the fund comes solely from employees. Employees are contacted and asked to contribute to the fund. The funds are used to a) send flowers to a bereaved employee, b) send birthday cards (ostensibly from the entire staff of the business), c) fund holiday bonuses for the top bosses.

Re: Soliciting employee donations

Generally, there is not going to be any restriction on this type of solicitation. There may be instances in which certain types of solicitations violate the FLSA, but that is going to occur more often when there is a mandatory deduction. If you have any further questions, or would like to discuss this matter in greater detail, please do not hesitate to contact me or my paralegal, Karen Nickelson.
