Legal Question in Legal Ethics in Tennessee

Phone Conversation Recorded and Available on Web w/o Permission

An applied and accepted student has recorded a phone conversation with a dean without the dean's knowledge nor permission. The conversation is available to listen to on the student's home page on the web. As the university we do not believe this is permissible, but the student states on the website that as long as the student was the originator/first party of the call, it is. Frankly, I think that is true for only private use, not third party dissemination. What's the law state?
