Legal Question in Personal Injury in Tennessee

homeowners liability

i have carried Farm Bureau home owners ins. for 22 yrs, and have now found out that I have no liabilty for personal injury. How can this be? I thought it was automaticlly on the policy? what can I do? I am being sued for a dog bite.

My suggestion is to demand a copy of the insurance policy, and read it very carefully. See if there is an exclusion for injuries caused by pets. If you think you are covered after reading the policy, contact your agent or at least someone from the insurance company and get further explanation as to why your claim is not being covered. You should probably follow up with a certified letter or evernight letter or something to show you have made a claim assuming you wish to make a claim. If you do not get any relief, you will need to hire counse. It would be a good idea to run the language of the policy by an attorney and obtain an opinion about whether you are covered. You have a number of options, but keep in mind that there are procedural rules that set out certain time constraints and deadlines. If a lawsuit has been filed as you state in your post, then you are likely going to have to answer the complaint whether the insurance co. provides you an attorney, you hire private counsel or represent yourself. Do not allow a default judgment to be taken while you work out the insurance issue.
