Negotiation After Litigation
After a lawsuit is filed, can a defendant's attorney attempt to negotiate a settlement with plaintiff's attorney?

Yes, and over 90 percent of civil suits are settled before trial.

Sure can. Most suits settle before trial, some on the courthouse steps, and some while waiting for the jury to come back in with a verdict. Negotiations can even take place after judgment has been taken, although the bargaining position is then far weaker.

Not only "yes", and Peter and Mike have said, but if your lawyer _isn't_ negotiating ... or refuses to negotiate ... you _need_ better counsel.
