Non employee limitation on liquidation purchasing
I sell liquidation goods. I have a few potential customers who are concerned with leaving their current source of product. They signed a contract that prohibits them from purchasing direct from a paticular company or another vendor of this same company. I sell liquidated products from the same company as this person. They are unsatisfied with the service they are receiving and would rather purchase from me but are concerned about the legality of their contract. My question is this inforceable? Their source is in Texas and they live in another state. These people are customers, not employees or independant contractors. They simply want to buy the same products but from a different source. I assume this clause is just a scare tactic and used to discourage people from leaving him as a customer. Am I right in this assumption?

If I could answer a question concerning a third-party contract, sight unseen, I wouldn't be practicing law for a living; I'd be doing a magic act in Vegas.
If your potential customer has concerns, let him talk to a lawyer.
