Legal Question in Business Law in Texas

Sue an attorney?

Since all attorneys are ''cut from the same cloth'', so to speak, will one litigate against another? If this is unlikey, what recourse do I have if an attorney's incompetence put me in jeopardy?

I disagree with your statement that "all attorneys are cut from the same cloth." There are many lawyers who handle legal malpractice claims and there are some who even specialize in it. I suggest you call a legal referral service and ask for someone who handles legal malpractice claims.

Re: Sue an attorney?

If you cannot resolve an issue with your attorney you can file a greivance with the State Bar of Texas and/or file a lawsuit for legal malpractice.

The State Bar can be reached at (800)932-1900 OR (800)204-2222, EXT. 1790

It is unfortunate you had a bad dealing with an attorney but lawyers are like doctors...there are some great ones, some good ones, and some quacks. Sadly, the bad lawyers and quacks that we often remember.

Re: Sue an attorney?

As in any area of endeavor there are good practitioners and bad. Yes, there are attorneys who sue other attorneys where the one being sued failed to meet the standards expected of any other attorney in the same or similar circumstance. Just because you may not like a result does not mean that the attorney was incompetent; that would have to be determined by other attorneys expert in the field, just like an accusation of medical malpractice has to be determined by other medical practitioners in the field.

Check with your local lawyer referral service for an attorney that handles legal malpractice.

And forget that "all attorneys are cut from the same cloth" bit. It's a bad attitude and will not get you accepted as a client.
