Legal Question in Construction Law in Texas
Who is responsible?
My brother has a small business that is being remodeled. He had purchased some stone and hired a guy to put it on the building. The contractor picked up the stone and took it to the business on a trailer(which is not fenced in). My sister-in-law told the contractor not to leave the stone and trailer there overnight but he said that is was fine because he had it chained down. Well one day they showed up to put the stone on the building to discover that the stone and trailer had been stolen. The contractor is wanting my brother to pay for all or part of the replacement stone but is it my brother responsible for the stolen stone? Or is the contractor responsible?

One question is whether the contractor is liable and another is whether he can cover it. Is he bonded? An attorney would need to review your agreement and related facts.
