Legal Question in Credit and Debt Law in Texas
Hot Check
I wrote a ck. in the amt. of 1500.00 to a garage to fix my car. they did not fix my car. This had been going on with them from Feb. 23rd to March 9. I had to miss some work over it. I am a single mother just tring to make it. I took the car to another shop they said none of the work had been done. I had no choice but to trade in my car. I needed a dependable car. I went to the bank an withdrew the 1500.00 for my down pymt. I was not aware at the time that the bank had returned the ck. to the garage NSF a few days before. This is my fault it was NSF. I thought my overdraft protection would cover the 150.00 I was short. I didn't know I would have had to use my credit card for the protection to cover the amt. I now have criminal chgs. against me for the hot ck. I am getting pymt. arrangements for this. My question is, what do I need to do to get my money back from the garage.

Re: Hot Check
Actually, you have a pretty good little DTPA case. Your damages are over $1,000 and you should be able to prove that the other garage did this "knowingly and intentionally". I guess the problem might be collecting from them. But maybe you could take their Snap On tool set. See a lawyer. Maybe you could find somebody to take this case.
