Legal Question in Credit and Debt Law in Texas

Motor Vehicle Ownership

In Nov,2001 we sold a car to a couple. They paid cash, refused a bill of sale, were to return following morning to complete transaction. title was in vehicle,7 months later, police impound informs us that our car has been impounded and we need to retrieve it. the title was left early that day at our gate with note please sign need to fix-urgent. We retrieved vehicle and have asked assumed purchaser(not person who orginally purchased from us) to repay all charges pretaining to vehicle. She refused and claims we stole her car. The police had also stripped car of illegal tags. Can we keep the car and ask her to pay charges ? She plans to go to small claims court

Re: Motor Vehicle Ownership

Of course there are a lot of missing variables here, however, it sounds like you should be able to recover your out of pocket expenses incurred in having to store a vehicle that was no longer yours. It is not clear as to whether or not you can keep the car until the fees are paid. What is her proof of ownership? You would not want to just turn the car over to someone claiming to owe the car only to find out that they did not really purchase it. You should definitely consult an attorney in order to straiten out this mess. It should be arranged so that everything is done simultaneously.
