Re: exponge record

In order to have a criminal record expunged, the case must have been dismissed. If there is a formal probation or sentence of any kind, i.e., a conviction, the record can never be expunged. However, if the individual received a deferred adjudication probation or deferred adjudication community supervision, then that record could be sealed. In other words, a "Petition for Non-Disclosure" can be filed to have the record sealed. However, law enforcement is one of about 23 state agencies in Texas that can find out about the criminal record even though the record is sealed. Without knowing more, about your particular situation this the best I can do to answer your question. You might want to contact a good criminal lawyer in your area of Texas. Good Luck.
