My husband & I got into a fight this past weekend. We argued and yelled. He grabbed me by my throat and screamed in my face he would kill me. He did not physically hurt me, though. I did not call the police because he left the house that night and did not return until the next day. I want a divorce; I want him to leave our home. I do not want him to have our 2 sons (who are 2 and 1). What can I do to get him out of the house? I am afraid I might actually get hurt if there is a next time.

Go to a lawyer's office and tell him/her this story. There are procedures to protect you and the children. The fact that you didn't call the police is one strike against you, but not the most important. An in this game the strikes are also more than just 1-2-3. If you feel the way you do and it's not going to change, do something about it now.

You need to file an Ex-Parte Protective Order or Restraining Order immediately.
