Legal Question in Family Law in Texas

I am in texas and i found out that my girlfriends son is mine but the other guys name is on the birth certificate if he is not the father how can i change my sons name. He is 5 now.

You would file a paternity suit which would ask the Court to make a finding that you are the biological father of the child. Mom would probably ask for DNA testing. If you are in fact the biological father, you'll be given some kind of court-ordered access to the child (visitation); you can even ask for full custody if you want to. And you'll probably be ordered to pay child support.
