Legal Question in Civil Litigation in Texas

Using my name

I recently sold a ranch in west Texas. A neighbor to that ranch is selling his ranch but in his advertisement he is stating that it is my old place. I've never owned his place. I've asked him to change his ad as people are calling me and asking me questions. I'm tired of fielding all the calls and I'm tired of him using my name to try to sell his place. What can I do?

You could bring a lawsuit asking for an injunction and perhaps damages. However, there may be an alternative to the expense of a lawsuit.

Consider this: Place a sign on your property but as close to his as possible, and inform the public: "BEWARE OF MISREPRESENTATIONS - [neighbor] is falsely and knowingly representing I previously owned his property. Why?" Surely, that will be an economical means of getting his attention.

Remember that "truth" is a defense to any libel claims that he may threaten.
