Legal Question in Civil Litigation in Texas

Verbal contract

If someone lent someone money with the promise that they would be paid back, does that count as a verbal contract? Is it legally binding? If they have not payed the person back after a year and have made no effort to pay in payments, do they have any recourse? What if we have a copy of the cancelled check and emails from their relatives speaking of the situation? Is there anything we can do?

Re: Verbal contract

Verbal contracts are enforeable and the e-mails and checks might be some evidence to support your claims. You might be able to win this case in the JP or Small Claims court.
