Legal Question in Immigration Law in Texas
Hello, i am from India & i am in USA since 2 years... But i am out of status because of layoff but my visa is still valid upto august 2011... I have a question can i send my wife home as she is on h4 visa status? Can she stay there for one month & will re-enter America again without any immigration issue? Your suggestion & attention towards this will be appreciated...

Both you and your wife are already out of status. You can't remain in the USA if you are no longer employed by your H1B employer. You both must depart the USA. The fact that a visa is still valid is irrelevant under the circumstances.
