Legal Question in Employment Law in Texas

Reduction In Force

I have been undergoing medical testing to diagnose a physiological problem (still testing) but was recently terminated for the stated reason: Reduction in Force. However, the company has now rehired or filled by position.

Is this legal?

Re: Reduction In Force

Only if it is a legitimate Reduction in Force (unlikely if they retained your position and filled it with a replacement) and not based on your Family Medical Leave or your actual or perceived (from the employer's perspective not your's)"physiological problem" (sic). A compliance review with F.M.L.A. and A.D.A laws are in order.
