Legal Question in Real Estate Law in Texas

Mis-managed property

Can I sue my Property Manag. Company for lost rents or failing to properly manage my 4-plex (in Texas)? I am forced to fly there from my home in CA in order to address repairs and maintenance issues. In Dec one of my tenants broke lease due to lack of service regarding water damage. The Prop. Manag. was severly delayed in contacting my Warranty Co. I approved repair costs in Dec in order to get the place in move-in condition again as soon as possible; as of Apr repairs still had not begun. I finally notified them(Manag. Co.) mid-Apr not to start if they have not already; because I was flying out there to address the issue personally, since I could no longer afford to cover the lost rent. Since my last complaint of them not being proficient at their jobs - I have conveniently stopped receiving my rent deposits. After 2 months I contacted them and they are 'not sure why I didn't receive them' and are going to ''re-send'' both months' rents, along with my monthly statements that I did not receive.

Re: Mis-managed property

It sounds as though you would have a cause of action for breach of contract and perhaps violations of the Texas Deceptive Trade Practices Act.

Contact my office to find out how we may be able to help straighten all of this out in a quick and cost effective manner.
