Legal Question in Traffic Law in Texas

The secretary would not let me speak to the JP.

I recently got a ticket for an expired inspection sticker. When I asked to speak with the JP, the secretary told me she was unavailable. The secretary then proceeded to tell me how much the ticket was ($130), and where to send it. I thought this was a little expensive so I called another County and they said it was about the same amount, but if the violation was corrected it was only a $10 fine. I called again, and asked to speak with the JP, and was denied the oppertunity. My question is, since I was denied the oppertunity to speak with the JP is this grounds for getting the ticket dismissed?

No it isn't. Although JP court is more informal than other courts, this is still what is known as an 'ex parte communication'. A case cannot be discussed by the judge with one party, unless the other party is present. The JP's secretary is usually very knowledgeable and sometimes helpful. Ask her if there is special consideration if the sticker is replaced within 10 days and is less than 60 days expired. TCL
