Legal Question in Wills and Trusts in Texas

Husband left $5000 in life insurance policy to dead parents as beneficiaries. How can I get the funds without going through probate? I sent copies of death certificates of husband, inlaws and copy of our marriage certificate to insurance company. So far no luck. Am I going to have to spend 1,000 to get $5,000?

Sad..but insurer considers the parents may have had other children? if not, then was H previously married with children?..not simple..so visit a good probate lawyer..as parents estate is where proceeds go..and to their heirs...
