Legal Question in Wills and Trusts in Utah

No will and quitclaim

My parents passed away last year. My brothers want to have the property split between the six siblings, my two sisters say the property is theirs because they have a quitclaim deed. I want to take it probate,so that it can be divided equally between us. Do my sisters have the property and the rest of us nothing?

Re: No will and quitclaim

You should open probate and have the property adjudicated. A quit claim deed which has not been properly recorded prior to the death of your parents is worthless. As a child you can open probate and request to be named the personal representative of the estate.
