Legal Question in Family Law in Virginia

co-habitation

My ex is getting remarried and has decided to let her fiancee move in before they are married. We have shared joint custody of the kids, I feel like this sends the wrong message to the kids. What legal rights do I have. Can I take full custody of the kids? Would a judge move quickly on this, or would it drag out until she was married, making it a moot point?

Re: co-habitation

Yes, you could, of course, file for full custody, however, whether this particular development in the case would be considered by the judge a change sufficiently material in the circumstances affecting the best interests of the children that would warrant granting you full custody is unclear. And, how quickly the case could be scheduled for a hearing would in large measure depend upon the court involved.
