Primary Custody

I want to get primary custody of my 7 year old son. He is in Norfolk VA with his grandmother. The mother stays in another state. I live in Milwaukee, WI. I have to get a lawyer there because the child is staying in Norfolk. I sign a paper for child support but it was not court order stated by the child support agency in Norfolk Va. Also my son was born in Germany while I was in the ARMY.

Summary To get Primary Custody of son.

Yes, you'll need a Virginia lawyer to represent you in any attempt you initiate to wrest custody of your son from his maternal grandmother.

And, you will need to demonstrate by a preponderance of the evidence that the various factors which the court is legally bound to consider in adjudicating the custody matter favor you as likely being more conducive to promoting the best interests of your son by having you as his primary custodial caregiver rather than his materal grandmother. And, that may be more difficult than you think.
