Legal Question in Immigration Law in Virginia

I entern the united states crossing the border on 1998, currently i am 26 years old, married and have a 8 years son born in the usa. i graduated from high school in 2003 and went to northern virginia comunity collegue for two years to take soem english courses. on 2000 why the 241 law came out my father apply for the labor certificate for the whole family including me through his job, once the labor certificate was approved the imigration procedure started butu nfortunally i was pregnant at that time and got married so i was out of the process. Now my mother is us citizen i would like to know if she petions me can i remin in the usa? apply for a owrk permint? does the 241 I law protects me not to be protected? or is there any other law that for the time i am in the usa more than 10 years can i appy to the green card? or i could qualify for the dream act if its approved. can some body please help me, i really appreciated a lot.

You need to consult a lawyer in private and off the public forum. There are just too many facts and circumstances that have to be reviewed and taken into consideration before I can advise you.

If you were married when your father's employer filed I-140 (provided that it was filed prior to April 30, 2001), you are NOT protected by INA 245i. If you were single and under 21, then you might be protected.

The DREAM Act hasn't become a law yet. If and when it becomes a law, yes, you might have a chance to legalize your status.

As to whether there are any other available options, you need to consult a lawyer.
