Legal Question in Medical Malpractice in Virginia

Possible Medical Malpractice

My wife had surgery on the 17th of December. On the 18th, she was released, and came back in twice for excessive bleeding. During both of these visits she was administered IV fluids and blood. When she was admitted that evening, she was having chest pains and low blood pressure. She was later sent to another hospital where she was diagnosed as having fluid in her lungs from having too much IV fluid and blood administered. She was admitted to the second hospital and treated there where she suffered through tremendous chest pain that was barely controlled through heavy use of morphine. She was released this Sunday the 23rd. Is there basis for a malpractice suit and possible pain and suffering? Your prompt resopnse would be appreciated as I do not know the statute of limitations on this type of problem. Thank You.

Re: Possible Medical Malpractice

Did the standard of medical care which your wife received in the first hospital fall below the acceptable standard of care then prevailing in that particular community at that particular time is more or less the pertinent legal question.

Based upon the facts which you've provided, I really have no idea (which probably means that it's quite a complicated legal question).
