Legal Question in Business Law in Washington

I would like to open a Truck Driving School with two partners. One partner is an African/Canadian citizen and the other partner is a citizen of India and both are here in the USA on a work visa. I am a US citizen. How do we go about becoming limited partners and is it even possible since they are not US citizens?

It is not a problem to become partners in a US business, such as your proposed truck driving school. There are no limits to who (citizen or foreigner) can own or form a corporation in the US, at least not until you get into huge mega-size corporations (think Standard Oil, Microsoft, etc.) when citizenship of majority owners comes into play for reasons of national security.

At the small company start up level though, you are fine. If your partners are here on work visas, they will need to remain employed in those positions to retain those work visas. If they want visas based upon their ownership in this company, and if they are going to take an active part in running it (act as managers of the corporation) then that's going to complicate their immigration situation, and that is something we would need to discuss for me to get more information to more accurately advise you.

As a Franchise Attorney I basically agree with the answer posted by the above attorney. You definitely need an attorney for the business side and immigration side. If one attorney can do both, that's even better. Consult with a good business or franchise attorney for specific advice.
