Legal Question in Constitutional Law in Washington
First time DUI
My boyfriend who has a clean record just got pulled over for a DUI, his Breathalyzer test came back as .118. Is there anyway for this to not go on his record, if it does then he wont be able to get a job as an automotive technician and that's what he went to school for. He's willing to do anything to keep it off his record. Does he have any options that would allow this to stay off of his record? Thank you for any help you can offer.

Re: First time DUI
The prosecutor might be willing to offer a plea bargain involving a lesser charge, but I wouldn't bet on this. Prosecutors consider DUI a serious matter, and rightly so. They have little reason to go easy on a defendant whose guilt they can prove. The fact that your boyfriend doesn't want to face the consequences of his actions is irrelevant to the prosecutor's decision.
Assuming he is convicted and depending upon the specifics of his case, your boyfriend may eventually be able to have his conviction expunged. Even if he is able to do this, it won't be an option anytime soon. At least for the near term, he will need to find a new line of work.
