Legal Question in Wills and Trusts in Washington

Executor of Estate

My Father was left Executor of his mothers estate. When she passed away, all of his brothers and sisters signed a document, drawn up by a lawyer, stating that they were giving up their interest in the estate and it would then be in his name. He then had the lawyer file the paper work. After about 1 month, the brothers and sisters have decided they want money for the house. They are threatening to sue my father and put a lein against the house. It has only been 3 months since my grandmothers death and he has not gotten any paperwork back from the laywer stating the house is in his name, but was assured he should be recieving it shortly. One of the brothers tried to have his name removed from the contract but was told it was to late. Can they sue him, put a lein against the house, or do anything to force him to sell it for a certain price?

Re: Executor of Estate

Assuming that the document the lawyer drew up stated that your aunts and uncles' shares were gifts to your father, and there are no circumstances that would indicate they intended otherwise, then no, I do not think they will succeed in a suit against your father, or be able to force him to sell.

However, that does not mean that they won't or cannot try. Lawsuits can get pricey and emotionally painful, especially considering that all this comes on the heels of your grandmother's passing.

I hope this helps.
