How many year do you wait before filing bankruptcy again?

My husband filed bankruptcy four years ago with his first wife and almost everything we have now has my name as the primary person, we need to file bankruptcy due to illness and loss of employment. Can we still file since he filed four years ago?

Your husband must wait 6 years from the date he filed earlier. You are eligible for a Chapter 7. Both of you are eligible for a Chapter 13. You should gather the bills and note which ones either or both of you are obligated to pay, that is, if the creditor has a writing signed by one or both of you, (exception for Dr. Hosp. bills) and go see a bankruptcy lawyer to discuss both a Chapter 7 for you and a Chapter 13 for both.
