Legal Question in Family Law in California

Money Owed In Divorce

My ex husband and I divorced in 1996. We've been married for almost 5 yrs. In the final judgement he's supposed to give me $5,000. He asked me if he could pay me in installment and I agreed. He has only given me in total $450, and the last checked that I have received from him was in 1998. Could I still go after the money that he owed me? Is there a statue of limitation regarding the time lapsed? Thank You.

Depending on the wording of the judgment, you could probably still collect the funds from him. You may also be able to collect 10% annual, simple interest on the unpaid amount. You will probably need an attorney. But you could start with an abstract of judgment and also execute against any bank account that he may have or vehicles, etc. Don't delay because you do not have forever to collect this debt.
